This Privacy Policy describes how LendSure ("we," "us," or "our") collects, uses, and shares information when you use our websites, applications, and services (collectively, the "Services"), including when borrowers use our platform to complete income and employment verification on behalf of participating lenders and other organizations ("Clients").

By using our Services, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with this Policy, please do not use the Services.


1. Information We Collect

We collect information in a few different ways:

1.1 Information You Provide to Us

  • Account & Organization Information. If you are a lender or other Client, we may collect information such as your name, business name, email address, phone number, billing details, and any other information you choose to provide when you sign up for and use the Services.
  • Borrower Information. If you are a borrower using our verification flow, we may collect your name, mobile phone number, and other information that you or your lender provide to enable income and employment verification.
  • Support & Communications. If you contact us (for example via email or a support form), we collect the information you provide in that communication.

1.2 Information We Receive from Third Parties

Our Services may integrate with third-party providers (such as Argyle and messaging providers) to facilitate secure payroll connectivity, verification, and messaging. When you connect your payroll account or complete verification, we may receive certain information from these providers (for example, employment and income data) as directed by you and/or our Client.

1.3 Automatically Collected Information

When you use our Services, we may automatically collect certain information about your device and usage, including:

  • IP address
  • Browser type and version
  • Device identifiers
  • Pages or screens viewed and actions taken
  • Date and time of access
  • Referring/exit pages and URLs

We may use cookies or similar technologies to help operate and improve the Services.


2. How We Use Information

We use the information we collect for purposes including:

  • Providing, operating, and maintaining the Services.
  • Facilitating income and employment verification on behalf of our Clients.
  • Sending transactional communications, such as SMS messages related to verification flows.
  • Responding to requests, questions, and support inquiries.
  • Monitoring and improving the performance, security, and reliability of the Services.
  • Complying with legal obligations and enforcing our agreements.

3. SMS & Mobile Data

Our Services may use text messaging (SMS) to send borrowers secure links and updates related to their income and employment verification. When you provide your mobile number and consent to receive such messages, we will use your number only as described in this Privacy Policy and in the opt-in notice presented at the point of collection.

We do not share, sell, rent, or disclose mobile phone numbers or SMS opt-in data with third parties or affiliates for their own marketing or promotional purposes.

Mobile information may be shared with subcontractors and service providers solely to support the Services (for example, with our SMS delivery provider to send messages on our behalf or with customer support tools), but:

  • Such subcontractors are only permitted to use mobile information to perform services for us; and
  • SMS opt-in data, consent records, and mobile numbers will not be shared with any third parties for other purposes, including marketing or promotional use.

Message frequency, message content, and opt-out instructions (e.g., "Reply STOP to opt out, HELP for help") are disclosed to users at the time of opt-in. Message and data rates may apply.


4. How We Share Information

We do not sell your personal information. We may share information as follows:

  • With Clients. If you are a borrower using our verification flow, we share necessary verification-related data (for example, income and employment information obtained via integrated providers) with the lender or organization that requested the verification.
  • Service Providers & Subcontractors. We may share information with third-party vendors and service providers that perform services on our behalf, such as hosting, data storage, analytics, messaging (e.g., SMS delivery), and customer support. These parties are authorized to use your information only as necessary to provide services to us.
  • Legal & Compliance. We may disclose information if we believe it is necessary to comply with applicable laws or regulations, legal processes, or lawful requests by public authorities; to enforce our Terms of Service or other agreements; or to protect the rights, property, or safety of LendSure, our Clients, users, or others.
  • Business Transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction, subject to the protections of this Privacy Policy.

As noted above, mobile phone numbers, SMS opt-in data, and consent will not be shared with third parties for marketing or promotional purposes.


5. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. The specific retention period may vary depending on the nature of the data and the purposes for which it was collected.


6. Security

We use reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, use, or disclosure. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.


7. Your Choices & Rights

  • SMS Communications. You can opt out of SMS messages at any time by following the instructions in the message (for example, by replying "STOP"). Please note that you may still receive important non-SMS communications as permitted by law or as necessary to provide the Services.
  • Access & Update. If you are a Client, you may update certain account information by logging into your account or contacting us. Borrowers may need to contact their lender or the requesting organization to update certain information.
  • Cookies & Tracking. Depending on your browser settings, you may be able to refuse or delete cookies. If you do so, some features of the Services may not function properly.

8. Third-Party Services & Links

The Services may contain links to third-party websites or services, or integrate with third-party platforms (such as payroll connectivity providers or SMS delivery services). We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies to understand how they handle your information.


9. Children's Privacy

Our Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe that we have collected information from a child under 13, please contact us so that we can take appropriate action.


10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. If we make material changes, we may provide additional notice (such as by email or a prominent notice on our website), as required by law. Your continued use of the Services after any changes take effect constitutes your acceptance of the updated Privacy Policy.
